evroc – Acceptable Use Policy
1. Purpose and scope
This Acceptable Use Policy ("AUP") forms an integral part of the Agreement between evroc and the Customer and governs the use of the Services. This AUP applies to the Customer and all Users. The purpose of this AUP is to ensure that the Services are used in a lawful, responsible, and secure manner, in compliance with evroc's core values.
Capitalised terms used but not defined in this AUP are defined in the General Terms or otherwise in the Agreement.
2. Prohibited Use
2.1 Illegal Activities
The Customer and Users shall not use the Services to:
(a) Engage in or facilitate any activity that violates law, including any financial crimes or terrorism financing;
(b) Distribute, store, or transmit content that infringes any intellectual property rights;
(c) Gain unauthorized access to computer systems or networks;
(d) Distribute malware, viruses, trojans, worms, or other malicious software or code;
(e) Conduct fraud, identity theft, or phishing schemes;
(f) Violate GDPR or other applicable data requirements or fail to comply with sector specific regulations (e.g. DORA for financial data);
(g) Violate import/export control laws or sanctions regulations applicable within the European Union; or
(h) In any way case damage or injury to any person or property.
2.2 Harmful Content
The Customer and Users shall not use the Services to host, distribute or transmit:
(a) Content that constitutes hate speech, incites violence or that may be deemed as threating in any way;
(b) Child sexual abuse material or any content that sexualises minors in any way;
(c) Non-consensual intimate content;
(d) Pornography;
(e) Content that promotes terrorism or violent extremism;
(f) Defamatory, discriminatory, harassing, obscene, racially offensive or ethnically offensive content targeting individual or groups; or
(g) Content that unlawfully infringes privacy right or processes personal data in violation of applicable laws.
2.3 Network Security and Integrity
The Customer and Users shall not use the Services to:
(a) Launch denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks;
(b) Scan, probe or test the vulnerability of any system (including evroc's systems) without written authorisation from the system owner;
(c) Circumvent or attempt to bypass any security measures or access controls;
(d) Send unsolicited bulk messages (spam) or engage email harvesting;
(e) Engage in cryptocurrency mining without evroc's explicit prior written consent;
(f) Consume excessive resources in a manner that impacts the availability of the Services for other evroc customers; or
(g) In any way damage or interfere with the Services, Services provided to evroc's other customers or evroc's IT (including software, hardware, information technology, systems and services owned or licensed by evroc, which are used by evroc to provide the Services or perform its obligations under the Agreement).
2.4 Qualification and Account Use Limitations
The Customer and Users may not:
(a) Access the Services without being a verified legal entity or individual by evroc;
(b) Be under any sanctions by the European Union;
(c) Gain access to the Services from a country sanctioned by the European Union; or
(d) Share its account with any other legal entity or individual without evroc's written consent.
3. Monitoring
3.1 evroc reserves the right to, without prior notice:
(a) Use automated systems to detect prohibited content or activities;
(b) Scan for malware security threats and any other violations of this AUP;
(c) Monitor resource usage and network traffic patterns; and
(d) Review content reported to evroc.
4. Customer's Cooperation
In case evroc, in its sole discretion, suspects that the Customer or any User has acted in breach of this AUP, evroc may conduct an investigation regarding the matter. In case of such investigation, the Customer shall cooperate fully with the investigation, provide requested information within reasonable timeframes, accept responsibility for the actions of any User, and implement corrective measures as directed by evroc.
5. Enforcement
If evroc detect use which, in its sole discretion, constitute any breach of this AUP, evroc may suspend the Customer's or any User's use of the services permanently or temporarily, report illegal activities to relevant authorities, and/or seek damages for costs caused by the violation.
6. Amendments
evroc may without prior notice make changes to this AUP provided that evroc uses commercially reasonable efforts to minimise any disruption of the Services in connection with such changes.

Any violations of this AUP may be report to evroc at legal@evroc.com.
